Effective: 2025
These Terms and Conditions govern the use of the services provided by EnomHost Networks ("EnomHost", "we", "us", or "our"). By purchasing, accessing, or using any EnomHost service, you ("you", "customer", or "client") agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not purchase or use EnomHost services.
EnomHost provides web hosting, WordPress hosting, domain registration, domain migration and related website services. The features, storage limits, website limits, resource allocations, and other specifications of each service are described on the applicable EnomHost website or service page. EnomHost reserves the right to modify or update its services, features, specifications, and infrastructure when reasonably necessary. Where a change materially affects an existing service, EnomHost will provide reasonable notice where appropriate.
To purchase or use EnomHost services, you may be required to create an account and provide certain personal and billing information. You agree that all information provided to EnomHost must be accurate, complete, and kept up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account. If you believe that your account has been accessed without authorization or that your login information has been compromised, you must notify EnomHost as soon as reasonably possible.
Each EnomHost hosting package includes specific resource limits and allocations. These may include storage capacity, CPU resources, memory, website limits, databases, email services, and other technical resources. Customers must use their hosting account in a reasonable manner and must not use the service in a way that negatively affects the performance, security, stability, or availability of EnomHost infrastructure or other customers' services. If an account uses excessive resources or causes a significant impact on the server or other customers, EnomHost may contact the customer and require the issue to be resolved. This may include reducing resource usage, optimizing the website, or moving to a more suitable hosting package.
Domain names registered through EnomHost are subject to the policies, requirements, and terms of the relevant domain registry and registrar. The availability of a domain name cannot be guaranteed until the registration has been successfully completed. Customers are responsible for ensuring that their chosen domain name does not infringe the intellectual property, trademark, or other rights of another person or organization. EnomHost may require accurate customer information and verification documents where required by a domain registry, registrar, or applicable law.
EnomHost offers a free .co.za domain registration with qualifying hosting plans and all Managed WordPress hosting plans. The free .co.za domain is available subject to the requirements of the applicable hosting package and is intended for eligible new domain registrations. Unless otherwise stated by EnomHost, the free domain benefit is limited to one qualifying .co.za domain per eligible hosting service. The free domain has no cash value and cannot be exchanged for cash or another service. The free domain benefit applies to the initial eligible registration period only. Any future domain renewal may be charged at the then-current EnomHost renewal price unless otherwise stated.
EnomHost provides free migration of eligible .co.za domains to EnomHost. Domain migrations involving other domain extensions may be subject to a migration or transfer fee. The customer is responsible for providing the correct information and authorization required to complete a domain transfer. EnomHost cannot guarantee that a domain transfer will be successful where the transfer is prevented by the existing registrar, domain registry, domain status, incorrect information, or circumstances outside EnomHost's control.
EnomHost services must be paid for according to the billing cycle and pricing selected by the customer. All invoices are payable by the due date shown on the invoice. Customers are responsible for ensuring that their invoices are paid on time and that any payment method provided to EnomHost remains valid. EnomHost reserves the right to change its pricing for new purchases and future renewals. Where applicable, customers will be notified of changes to recurring service pricing before the new price is charged.
If a hosting account remains unpaid after the invoice due date, EnomHost may restrict or suspend the affected service. An account may be suspended 10 days after the invoice due date if payment has not been received. During suspension, the customer's website, email services, databases, and other services associated with the account may become inaccessible. The customer may restore the service by paying all outstanding amounts, subject to any applicable requirements. If the account remains unpaid, EnomHost may terminate the service 30 days after the original invoice due date. Following termination, EnomHost may permanently delete the hosting account and any data associated with it. Customers are responsible for maintaining their own backups of important website files, databases, emails, and other information.
EnomHost provides a 7-day money-back guarantee on eligible hosting services. A customer may request a refund within 7 days of the initial purchase if they are not satisfied with an eligible hosting service. The 7-day money-back guarantee applies to eligible hosting service fees only. Domain-related fees are non-refundable. Domain registration, domain transfer, domain renewal, and other domain-related charges are non-refundable. Where a free .co.za domain was included with a qualifying hosting package and the customer subsequently requests a refund or cancels the service, the domain registration cost may still be payable by the customer where applicable. The money-back guarantee does not apply to subsequent renewals, additional services, add-ons, domain-related charges, or services specifically identified by EnomHost as non-refundable. EnomHost reserves the right to refuse a refund where there is evidence of fraudulent activity, abuse of the money-back guarantee, repeated refund requests, or a material violation of these Terms and Conditions.
EnomHost services may only be used for lawful purposes. Customers must comply with all applicable laws and regulations when using EnomHost services. EnomHost does not permit the hosting, distribution, storage, or operation of illegal content or activities. This includes content or activities involving fraud, phishing, malware, hacking, unauthorized access, stolen data, piracy, copyright infringement, or other unlawful activities. EnomHost does not permit websites or accounts primarily used to distribute pirated software, movies, music, games, books, applications, or other copyrighted material without authorization. EnomHost also does not permit adult or pornographic content on its hosting services. This includes websites that contain or primarily distribute sexually explicit material or pornography. Any content involving the sexual exploitation of children is strictly prohibited and may be reported to the appropriate authorities where required by law. Customers must not use EnomHost services to conduct activities that compromise the security, stability, or performance of EnomHost infrastructure or other customers' services.
EnomHost services may not be used to send unsolicited bulk email, spam, phishing messages, fraudulent communications, or other abusive email. Customers are responsible for ensuring that email sent from their domains and hosting accounts complies with applicable laws and accepted email practices. If an account is found to be responsible for significant spam, email abuse, or activity that threatens the reputation or operation of EnomHost's mail infrastructure, EnomHost may restrict, suspend, or terminate the affected service.
Customers are responsible for all content uploaded, stored, published, or distributed through their EnomHost account. Customers must have the necessary rights, licenses, and permissions to use the content hosted through EnomHost. EnomHost does not claim ownership of legitimate customer content. However, customers grant EnomHost the limited rights necessary to store, process, transmit, back up, and provide access to such content for the purpose of delivering the purchased services. If EnomHost receives a valid legal complaint, court order, takedown request, or other legally valid notice concerning potentially unlawful or infringing content, EnomHost may take appropriate action, including restricting access to the content or suspending the affected service.
Customers are responsible for maintaining the security of websites, applications, plugins, themes, scripts, content management systems, and other software installed on their hosting accounts. Customers should keep their software updated and use appropriate security measures to protect their websites and accounts. If a website or hosting account becomes compromised and creates a security risk to EnomHost infrastructure or other customers, EnomHost may temporarily restrict or suspend the affected service in order to protect the hosting environment.
Where backups are provided as part of an EnomHost service, such backups are intended as a recovery measure and should not be considered the customer's only copy of their data. Customers are responsible for maintaining independent backups of important website files, databases, emails, and other information. EnomHost will make reasonable efforts to maintain available backups and assist with restoration where applicable. However, EnomHost does not guarantee that every file, database, email, or other piece of information can be restored in every circumstance. EnomHost is not responsible for data loss caused by customer actions, compromised accounts, malware, software failures, third-party applications, or circumstances outside EnomHost's reasonable control.
EnomHost aims to provide reliable and stable hosting services but does not guarantee uninterrupted or error-free availability. Services may occasionally be unavailable because of scheduled maintenance, emergency maintenance, hardware failures, software failures, network problems, datacenter issues, upstream provider problems, cyberattacks, internet outages, or other circumstances outside EnomHost's reasonable control. Where reasonably possible, EnomHost will provide advance notice of planned maintenance that is expected to significantly affect customer services.
EnomHost provides customer support through the support channels made available on its website. Support is intended to assist customers with EnomHost services and hosting-related issues. Support does not necessarily include website development, programming, graphic design, third-party software development, or extensive customization of applications. EnomHost may provide general assistance with third-party software but cannot guarantee compatibility or resolution of problems caused by third-party applications, plugins, themes, or services.
EnomHost may use third-party providers to operate or support certain aspects of its services. These providers may include domain registries, payment processors, server and datacenter providers, security providers, software providers, and other technology providers. Third-party services may be subject to their own terms, conditions, licenses, and privacy policies. EnomHost is not responsible for changes, interruptions, vulnerabilities, or discontinuation of third-party services outside its reasonable control.
EnomHost may immediately suspend or restrict an account where reasonably necessary to protect its infrastructure, network, systems, employees, customers, or third parties. This may occur where an account is involved in hacking, phishing, malware distribution, spam, fraud, illegal activity, serious security threats, or other activity that creates a significant risk to EnomHost or its customers. Where reasonably possible, EnomHost will notify the customer of the reason for the suspension and may provide an opportunity to resolve the issue.
Customers may request cancellation of their EnomHost services through the cancellation process made available by EnomHost. Cancellation does not automatically entitle a customer to a refund. Refunds are subject to the 7-day money-back guarantee and the other refund provisions contained in these Terms and Conditions. Domain registration, domain transfer, domain renewal, and other non-refundable charges remain non-refundable after cancellation.
EnomHost may terminate a customer's account where the customer materially violates these Terms and Conditions, fails to pay outstanding amounts, engages in illegal or prohibited activity, creates a serious security or operational risk, provides fraudulent information, or otherwise abuses EnomHost services. Where appropriate, EnomHost may provide notice before termination. However, immediate termination may occur where necessary to protect EnomHost, its customers, its infrastructure, or to comply with legal obligations.
To the maximum extent permitted by applicable law, EnomHost will not be responsible for indirect, incidental, special, consequential, or other losses arising from the use of, or inability to use, EnomHost services. This may include loss of profits, loss of revenue, loss of business opportunities, business interruption, or loss of data. Nothing in these Terms and Conditions is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable South African law.
The customer remains responsible for their website, domain names, content, applications, account credentials, backups, and use of EnomHost services. The customer is also responsible for ensuring that their use of EnomHost services complies with applicable laws, regulations, third-party rights, and these Terms and Conditions.
EnomHost may update these Terms and Conditions from time to time to reflect changes to our services, business practices, legal requirements, or other circumstances. The updated version will be published on the EnomHost website together with the applicable revision date. Where required by law, EnomHost will provide appropriate notice of material changes.
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms and Conditions or the use of EnomHost services will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts.
